Agreement to Terms

These Terms apply to all visitors, users, and customers of the MacCollys website ("Site"). MacCollys LLC ("MacCollys," "we," "us," or "our") may update or modify these Terms at any time without prior notice. Continued use of the Site after changes constitutes acceptance of the revised Terms.

These Terms also incorporate by reference our other policies, including our Privacy Policy and any additional posted policies (including shipping and return-related policies where applicable). If there is a conflict between these Terms and a posted policy, these Terms control unless we explicitly state otherwise.

Products & Condition Disclosure

MacCollys is a liquidation retailer selling physical goods sourced from excess, returned, overstock, and closeout inventory through major retailers and trusted supply channels. Product availability is limited and inventory changes frequently.

Product condition is disclosed on each listing and may include: New, Open-Box, Used, Refurbished, or Salvage. Certain items may be sold as-is. Manufacturer warranties may not apply.

Customers are responsible for reviewing all product details, condition notes, photos, and listing information prior to purchase.

Orders, Pricing & Payments

• All prices are listed in U.S. dollars.
• Sales tax is charged where required by law.
• Payments are processed through third-party providers such as Stripe and PayPal (additional methods may be offered later).
• We reserve the right to cancel or refuse any order due to pricing errors, inventory discrepancies, suspected fraud, payment issues, or policy violations.
• Orders may be canceled within 3 hours of purchase, provided the order has not yet shipped.

If we cancel an order after payment has been captured, we will issue a refund to the original payment method. Processing times for refunds may vary by payment provider.

Customer Accounts & Eligibility

Customers may place orders as a guest or by creating an account. By using this Site, you represent that you are at least 18 years of age and legally capable of entering into a binding agreement.

You are responsible for maintaining the confidentiality of your account information and for all activities that occur under your account. We may suspend or terminate accounts that engage in fraudulent activity, abuse Site features, or violate these Terms.

Promotions, Coupons & Discounts

Promotional offers, coupon codes, and discounts may be subject to specific terms, conditions, and limitations. Eligibility, usage limits, expiration dates, and exclusions may vary depending on the promotion.

Coupon codes may be single-use, limited-use, or reusable depending on the offer. Discounts may not be combined unless explicitly stated.

We reserve the right to modify, suspend, or cancel any promotion or coupon at any time, including in cases of suspected abuse, error, or misuse.

Shipping & Delivery

MacCollys ships within the United States only. Orders typically process within 1–2 business days. Shipping carriers may include USPS, UPS, or FedEx depending on the size, weight, and nature of the item.

Once an order has been handed off to the carrier, delivery times and handling are the responsibility of the carrier. MacCollys is not responsible for carrier delays.

Returns, Refunds & Errors

Due to the nature of liquidation inventory, all sales are final unless an incorrect item was shipped by MacCollys.

• Returns are accepted only if the wrong item was sent.
• Return requests must be submitted within 14 days of delivery.
• MacCollys will provide a prepaid return shipping label for approved error-based returns.
• No restocking fees are charged for approved error-based returns.
• All other items are final sale and are not eligible for return or exchange.

Delivery Issues & Carrier Claims

MacCollys documents items prior to shipment. If a package is marked as delivered but not received, the customer must file a claim directly with the shipping carrier. MacCollys may assist with documentation, but is not responsible for carrier errors, theft, or misdelivery.

Fraud, Abuse & Prohibited Activity

You agree not to engage in fraudulent activity, abuse promotions, submit false claims, misuse payment methods, or interfere with the operation of the Site.

Prohibited activities include, but are not limited to: excessive chargebacks, return abuse, false delivery claims, automated scraping, bot usage, or attempts to circumvent Site safeguards.

MacCollys reserves the right to refuse service, cancel orders, suspend accounts, and pursue legal remedies where appropriate.

Limitation of Liability

To the fullest extent permitted by law, MacCollys LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages. In all cases, MacCollys LLC’s total liability shall not exceed the amount paid for the product giving rise to the claim.

Dispute Resolution & Arbitration

Any dispute, claim, or controversy arising out of or relating to these Terms, your use of the Site, or any purchase made from MacCollys LLC shall be resolved through binding arbitration, rather than in court, except where prohibited by law.

Arbitration shall be conducted on an individual basis. You and MacCollys LLC waive the right to participate in a class action or class arbitration.

This arbitration provision survives termination of these Terms.

Governing Law

These Terms are governed by and construed in accordance with the laws of the State of Nevada, without regard to conflict of law principles.
