1) Terms of Service

These Terms of Service (“Terms”) govern your access to and use of maccollys.com and any related services (collectively, the “Services”) operated by MacCollys LLC (“MacCollys,” “we,” “us,” “our”). By accessing or using the Services, you agree to these Terms and our Privacy Policy. If you do not agree, do not use the Services.

You represent that you are at least the age of majority in your jurisdiction and have the legal capacity to enter into these Terms. If you use the Services on behalf of an organization, you represent you have authority to bind that organization to these Terms.

We may update these Terms from time to time. Changes will be posted on this page with an updated effective date. Your continued use of the Services after changes become effective constitutes acceptance.

2) Accounts & Security

You may need an account to use certain features (e.g., checkout, order tracking, saved addresses). You agree to provide accurate information and keep it updated.

You are responsible for maintaining the confidentiality of your login credentials and for all activity under your account. Notify us immediately at support@maccollys.com if you suspect unauthorized access.

We may suspend or terminate accounts that violate these Terms, engage in fraud or abuse, or create risk to the Services or other users.

3) Orders, Pricing & Payments

Product listings. We aim to display accurate product information, including images, descriptions, and pricing. However, errors may occur (e.g., typographical errors, inaccurate inventory, incorrect pricing). We reserve the right to correct errors and cancel orders affected by errors at any time, including after an order is submitted.

Pricing & taxes. Prices are shown in U.S. dollars unless otherwise stated. Applicable taxes may be added at checkout based on your shipping address and local requirements.

Payment processing. Payments may be processed through third-party payment providers (e.g., Stripe and/or PayPal). By purchasing, you agree to the payment provider’s terms and acknowledge that we do not store full payment card details on our servers (though we may store payment tokens and transaction metadata).

Order acceptance. Your order is an offer to purchase. We may accept or reject any order in our discretion, including due to suspected fraud, inventory constraints, or shipping limitations.

Liquidation / open-box nature. Many products sold on MacCollys may be liquidation, overstock, or customer-return items. Condition can vary and is described on the product page when known. Packaging may show wear; accessories may be missing unless explicitly stated otherwise.

4) Refund & Returns Policy

Return policy summary: We only accept returns for items that are wrong (i.e., not what you ordered). We do not accept returns for buyer’s remorse or preference-based reasons. If an item arrives damaged in transit, we will assist with a carrier claim when you provide supporting evidence.

Wrong item return window (14 days). If you received the wrong item, you must contact us within 14 days of receiving the order to request a return. Requests outside this window may be denied.

How to request a wrong item return. Email support@maccollys.com with your order number and a description of the issue. We may request photos to confirm the item received.

Return condition. Approved wrong-item returns must be returned in the condition received, including any included accessories/parts and (when available) original packaging. Items that are altered, missing parts, or damaged after delivery may be ineligible for a refund or may receive a partial refund where permitted by law.

Return shipping. If we confirm the item shipped was incorrect, we will provide return instructions and/or a label. Do not ship an item back without receiving return authorization/instructions from us.

Damaged in transit (claim support). If your order arrives damaged, contact us within 48 hours of delivery at support@maccollys.com and include clear photos of: (1) the item damage, (2) the outer box (all sides), (3) internal packaging, and (4) the shipping label. We will use this evidence to help submit a carrier claim. Resolutions may include repair, replacement (if available), or refund depending on the claim outcome and item availability.

Refund timing. For approved wrong-item returns, refunds are issued to the original payment method after we receive and inspect the return. Banks/payment providers may take 5–10 business days to post the refund once processed.

5) Shipping Policy

Where we ship. We currently ship to addresses within the United States only. We do not currently offer international shipping.

Processing time. Orders typically ship within 1–3 business days (excluding weekends/holidays) unless otherwise stated on the product page. Processing time does not include carrier transit time.

Carriers & delivery estimates. We may ship via USPS, UPS, FedEx, or other carriers. Delivery estimates shown at checkout are not guaranteed and may be impacted by weather, carrier delays, or other events outside our control.

Shipping address accuracy. You are responsible for providing a correct shipping address. If an order is returned to us due to an incorrect or incomplete address, you may be responsible for reshipment costs.

Lost or stolen packages. If tracking shows delivered but you did not receive the package, contact the carrier and local authorities as needed, and notify us promptly. We may assist with claims, but we are not responsible for theft after confirmed delivery unless required by law.

6) Disclaimers & Limitation of Liability

As-is; no warranties. To the fullest extent permitted by law, the Services and all products are provided on an “AS IS” and “AS AVAILABLE” basis. We disclaim all warranties, express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

Limitation of liability. To the fullest extent permitted by law, MacCollys LLC will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses, arising out of or related to your use of the Services or products purchased through the Services.

Maximum liability. To the fullest extent permitted by law, our total liability for any claim arising out of or related to the Services or any product is limited to the amount you paid for the product or order giving rise to the claim.

Indemnification. You agree to defend, indemnify, and hold harmless MacCollys LLC from and against claims, liabilities, damages, losses, and expenses (including reasonable attorneys’ fees) arising out of or related to your use of the Services, your violation of these Terms, or your violation of any rights of another.

7) Intellectual Property

The Services, including text, graphics, logos, UI, and software, are owned by or licensed to MacCollys LLC and are protected by intellectual property laws. You may not copy, modify, distribute, sell, or lease any part of our Services without our prior written permission.

Any trademarks, product names, and brand names are property of their respective owners. Reference to third-party trademarks does not imply affiliation or endorsement.

8) Governing Law & Dispute Resolution

These Terms are governed by the laws of Nevada, USA, without regard to conflict of law principles.

Informal resolution first. Before filing a claim, you agree to contact us at support@maccollys.com and provide a brief description of the issue and your order number (if applicable). We’ll try to resolve disputes informally.

Forum. Unless prohibited by law, you agree that any legal action will be brought in state or federal courts located in Nevada, and you consent to personal jurisdiction in those courts.


9) Privacy Policy

This Privacy Policy explains how MacCollys LLC collects, uses, shares, and protects information when you use the Services. It also explains your choices and rights.

Information We Collect

We collect information in the following ways:

  • Information you provide: name, email, phone (optional), shipping/billing addresses, order details, support messages.
  • Transaction data: items purchased, amounts, timestamps, partial payment identifiers, and fraud-prevention signals. (We do not store full card numbers.)
  • Device & usage data: IP address, device type, browser, pages viewed, referring URLs, approximate location (derived from IP), and interactions with the site.
  • Cookies & similar technologies: to keep you logged in, maintain your cart, remember preferences, and measure site performance.

How We Use Information

  • To provide and operate the Services (checkout, order fulfillment, customer support).
  • To process payments and prevent fraud, abuse, and security incidents.
  • To send transactional communications (order confirmations, shipping updates, account verification).
  • To improve the Services (analytics, debugging, performance and UX improvements).
  • To comply with legal obligations and enforce our Terms.
  • If you opt in, to send marketing communications (you can opt out anytime).

How We Share Information

We may share information with:

  • Service providers: hosting (e.g., Hostinger), payment processors (e.g., Stripe/PayPal), shipping/carrier tools, email delivery vendors, analytics providers.
  • Compliance and legal: to comply with law, respond to lawful requests, or protect rights, property, and safety.
  • Business transfers: in connection with a merger, acquisition, financing, reorganization, or sale of assets (with appropriate safeguards).

We do not sell your personal information in exchange for money. (See “Your Privacy Rights” below for opt-out options related to targeted advertising.)

Data Retention

We retain information for as long as necessary to provide the Services, comply with legal obligations, resolve disputes, and enforce agreements. For example, order and payment-related records may be retained for accounting, tax, and fraud prevention purposes.

Security

We implement reasonable administrative, technical, and physical safeguards to protect information. However, no method of transmission or storage is 100% secure. You are responsible for maintaining the security of your account credentials.

Children’s Privacy

The Services are not intended for children under 13, and we do not knowingly collect personal information from children under 13. If you believe a child has provided personal information, contact us to request deletion.

10) Cookies & Analytics

We use cookies and similar technologies to:

  • Maintain your cart and session (essential cookies).
  • Remember preferences (functional cookies).
  • Measure performance and understand usage (analytics cookies).
  • Help prevent fraud and protect accounts (security cookies).

You can control cookies through your browser settings. Disabling certain cookies may impact site functionality (e.g., cart and login).

11) Your Privacy Rights

Depending on where you live, you may have rights regarding your personal information, such as: access, correction, deletion, portability, and the right to opt out of certain processing (e.g., targeted advertising).

California (CCPA/CPRA). California residents may have rights to know, delete, and correct personal information, and to opt out of “sharing” for cross-context behavioral advertising. We do not sell personal information for money. If we use advertising/analytics that may constitute “sharing,” you can opt out by contacting us or using any on-site opt-out mechanisms we provide.

EEA/UK (GDPR). If applicable, you may have rights to object, restrict processing, and withdraw consent (where consent is the basis). We generally process data to fulfill orders, provide the Services, comply with legal obligations, and for legitimate interests like security and service improvement.
